Terms of Service

1. Acceptance. By using www.southjerseyconstruction.biz or by engaging South Jersey Construction Consultants Inc. ("SJCC") for services, you agree to these Terms of Service.
2. Services. SJCC provides home improvement contracting services through four divisions: Replacement Windows, Replacement Siding, Replacement Roofing and Replacement Bathrooms. Service details are documented in each division's dedicated contract packet.
3. Estimates vs. contracts. Written estimates from SJCC are good-faith quotes based on the information available at the time. They are not binding agreements. A binding agreement is created only when both parties sign a written contract specific to the project.
4. New Jersey and Pennsylvania consumer protection. Our contracts comply with the NJ Consumer Fraud Act, the NJ Home Improvement Practices rules (N.J.A.C. 13:45A-16.1 et seq.), and the PA Home Improvement Consumer Protection Act (73 P.S. § 517.1 et seq.). You have a three-business-day right to cancel any home improvement contract signed at your home, as required by state and federal law. Cancellation instructions are included on every contract.
5. Warranties. Each division offers a workmanship warranty specified in its contract. Manufacturer warranties on materials pass through to you per manufacturer terms. SJCC does not warrant that products will meet every subjective expectation; we warrant that installation will be performed to industry standard and manufacturer specification.
6. Payment. Payment schedules are set in each project contract and typically include a deposit (within the limits NJ and PA law permit), a progress payment at a defined milestone, and a final payment on completion. Late payments accrue interest at the lesser of 1.5% per month or the maximum allowed by law.
7. Changes. Change orders must be in writing and signed by both parties before work on the change begins.
8. Dispute resolution. Any dispute arising out of or relating to a contract between you and SJCC that cannot be resolved informally will be submitted to binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will take place in Camden County, New Jersey, unless both parties agree in writing to another location. Judgment on the award may be entered in any court of competent jurisdiction. Nothing in this clause limits either party's right to pursue claims in small-claims court for amounts within that court's jurisdiction.
9. Governing law. These Terms and any contract between you and SJCC are governed by the laws of the State of New Jersey, except where PA law applies to work performed in Pennsylvania.
10. Limitation of liability. To the fullest extent permitted by law, SJCC's total liability for any claim arising out of a project is limited to the total amount paid under the project contract. SJCC is not liable for consequential, incidental or special damages.
11. Website use. Content on www.southjerseyconstruction.biz is for informational purposes. We make reasonable efforts to keep it accurate but do not warrant that it is free of errors. You may not copy, reproduce or redistribute site content without permission.
12. Changes to these terms. We may update these Terms from time to time. Material changes will be posted here with a revised date.
